ELIGIBILITY: This Incentive Promotion (“Promotion“) is open only to those who are eighteen (18) years of age or older, are located in the United States of America, and who meet the Additional Eligibility Criteria.
ADDITIONAL ELIGIBILITY CRITERIA: To qualify for the Promotion, you must be one of the first 50 people to open a Lendio bank account after May 1, 2023, and spend two thousand USD ($2,000) in the first two (2) months of opening Lendio business account, on or before September 30, 2023. In the event that you receive a refund for the amounts you have spent, dispute charges, or take other actions to decrease the amount spent below two thousand USD ($2,000), you will no longer be eligible. Eligible for the first 50 participants to reach these criteria. By participating in the Promotion as described in these terms and conditions (the “Promotion Terms”), each participant represents and warrants that he or she is eighteen years of age at the time of purchase and otherwise fully agrees and complies with these Promotion Terms.
HOW TO CLAIM YOUR REWARD: Within sixty (60) days after your account qualifies for the Reward, Lendio will send to the email associated with your account a method by which you can claim a Visa gift card, in the amount of fifty ($50) USD or one hundred ($100) USD depending on your transaction history (the “Reward”). In its sole discretion, Lendio may alter the method of delivery on a case-by-case basis. Lendio is not responsible for any inability to access the Promotion or claim a Gift Card due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. RESTRICTIONS AND AVAILABILITY: The Reward is provided only to those first 50 individuals who complete Promotion Terms on or before September 30, 2023. Limit (1) one reward per individual. Total fixed reward amount of seven thousand five hundred USD ($7,500) rewarded in fifty ($50) USD or one hundred ($100) USD increments. Maximum reward eligibility is one hundred USD ($100). Reward recipients (each a “Recipient“) assume all liability for any injuries or damage caused or claimed to be caused by participation in this Promotion or by the use or misuse of the Reward.
OTHER RULES: This Promotion is subject to all applicable laws and is void where prohibited. Having a current loan application with Lendio has no impact on eligibility for this incentive. All eligible transactions must be through the use of the Lendio mobile wallet card or physical use of Lendio debit card. ACH transactions through the Lendio business account are not considered eligible transactions. The promotion applies to those individuals who have not yet opened a Lendio bank account, as well as Lendio bank account users that have not deposited any funds yet. Account must be open when bonus is credited.
If, in Lendio’s opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Promotion, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Promotion, Lendio reserves the right to terminate the Promotion and distribute the Gift Cards in its sole discretion. Any attempt to deliberately damage Lendio’s website or undermine the legitimate operation of the Promotion may be in violation of U.S. criminal and civil laws and will result in disqualification from the Promotion. Should such an attempt be made, Lendio reserves the right to seek remedies and damages (including attorney’s fees) to the fullest extent of the law, including pursuing criminal prosecution.

DISPUTES: As a condition of participating in the Promotion, participants agree that any and all disputes that cannot be resolved between participant and Lendio, and causes of action arising out of or connected with the Promotion or these Terms and Conditions, shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in the State of Utah and participant irrevocably consents to the jurisdiction of the federal and state courts located in the State of Utah with respect to any such dispute, cause of action, or other matter. All disputes will be governed and controlled by the laws of the State of Utah (without regard for its conflicts-of-laws principles). Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby irrevocably waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than the participant’s actual out-of-pocket expenses (i.e., costs incurred directly in connection with participant’s participation in the Promotion), and participant further irrevocably waives all rights to have damages multiplied or increased, if any. EACH PARTY EXPRESSLY WAIVES ANY RIGHT TO A TRIAL BY JURY. All federal, state, and local laws and regulations apply.
